New York State Tax Crackdown Requires Prompt Action on Past-Due Taxes

NEW YORK, NY—August 7, 2013: On Monday, August 5, 2013, New York Governor Andrew Cuomo announced a new enforcement mechanism aimed at individuals who owe back taxes to New York State.  The measure, which applies to individuals with tax liabilities in excess of $10,000, allows the suspension of the New York State driver's license for individuals who do not fully pay or establish payment plans covering their tax liabilities.  Driving with a suspended license could result in arrest and fines.

"Taxpayers who receive suspension notices from New York State and others with outstanding back taxes should take quick action," said Rachel Partain, Of Counsel at Caplin & Drysdale.  "We know from experience that Department of Taxation and Finance is willing to work with taxpayers in resolving tax liabilities or establishing payment plans."

Anyone who has an outstanding tax liability with New York State should promptly contact their attorney to seek a solution that prevents the suspension of their driver's license.  The New York State Department of Taxation and Finance initially will be sending suspension notices to approximately 16,000 taxpayers.  If a taxpayer does not make payment arrangements within 60 days, a second notice will be sent providing an additional 15 days before the driver's license is suspended.
