Trevor Potter Quoted in The New York Times Blog, The Caucus, 'Ads and 30-Minute Special Will Promote Gingrich'

January 3, 2012, New York Times Blog, The Caucus

Newsmax and Mr. Ruddy have soured on Mitt Romney after endorsing him in 2008, when it called him "the Reagan candidate" on its cover.

Mr. Ruddy's feelings now? He said Mr. Romney has been too dismissive of Newsmax, whereas Mr. Gingrich has not. "So we have a comfort level with Newt. Woody Allen says 85 percent of success in life is just showing up. Well, Newt shows up."

Newsmax said it considered the video news programming, not political activity. Election law experts said the more problematic issues were with Liberty University's ad, which could be jeopardizing its tax-exempt status.

"It would be hard to think of a circumstance in which it could run and ad featuring a federal candidate in the middle of a primary or a caucus without raising serious tax-exempt questions," said Trevor Potter, a former chairman of the Federal Election Commission. "I hope they have good tax lawyers."

In a statement, Liberty University said their Gingrich commercial was not meant to be an endorsement.
