A married couple is suing UBS in U.S. federal court because the Swiss bank provided the IRS details of the wife’s account despite the fact that she had never been a U.S. citizen or resident.

Mark Matthews, a lawyer with Caplin & Drysdale specializing in tax controversies and litigation and former head of CI, told Tax Notes that Swiss law generally requires notice to account holders if their banking information is subject to potential disclosure. “And in our experience, Swiss banks have always been rigorous in following this requirement,” he said.
