Rachel Partain Discusses Exit Strategies for Captive Insurance Investors

A recent U.S. Tax Court victory for the Internal Revenue Service has spurred new efforts by advocates for captive insurance operations to prod the agency and Congress to provide more leeway for apprehensive investors.

Rachel L. Partain, a lawyer dealing with captive insurance cases for Caplin & Drysdale, said at the Atlanta conference that the twin IRS victories in Tax Court had prompted some investors to explore the possibility of exit strategies. But Partain said she has made the case "you can't really fold up" and such moves may not be needed.
